These Terms of Service ("Terms") govern your access to and use of Connect2Contact's contact intelligence, data verification, and campaign activation platform (the "Service"), operated by Connect2Contact Pvt. Ltd. ("Connect2Contact," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, uploading data, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Eligibility & Accounts
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. Use of the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes, including contact database upload, search, verification, and multi-channel campaign activation.
4. Uploaded Databases & Your Responsibilities
When you upload a database to the Service, you represent and warrant that:
- You have lawfully obtained the data and have the right to share it with us for processing.
- Use of the data for verification and campaign activation complies with applicable data protection, telecom, and DND regulations in India.
- You will not upload data obtained through unlawful means, scraping in violation of a website's terms, or data you do not have rights to use.
We reserve the right to reject, suspend processing of, or remove any database that we reasonably believe was obtained or is being used unlawfully.
5. Campaign Activation
Campaigns activated through WhatsApp, RCS, Email, Voice, or Print to Post channels must comply with applicable telecom regulations, including TRAI's Do Not Disturb (DND) framework and applicable consent requirements. We may require additional verification before activating certain campaign types and may decline campaigns that we believe violate applicable law or platform policies of third-party channel providers.
6. Fees & Payment
Certain features of the Service require payment of fees as described at the time of purchase. Fees are exclusive of applicable taxes unless stated otherwise. Failure to pay outstanding fees may result in suspension of Service access. Refunds, where applicable, are governed by our Refund Policy.
7. Intellectual Property
The Service, including its software, design, and underlying technology, is owned by Connect2Contact and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features except as necessary to use the Service as intended.
8. Prohibited Conduct
You agree not to:
- Use the Service for unsolicited bulk communications that violate applicable DND or anti-spam laws.
- Upload data containing sensitive personal information without a lawful basis to process it.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to harass, defraud, or mislead any third party.
9. Suspension & Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, applicable law, or pose a risk to the Service, other users, or third parties. You may stop using the Service at any time; certain provisions of these Terms will survive termination, including those relating to liability and indemnification.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. While we apply human review and verification to uploaded data, we do not guarantee that all records will be entirely accurate, complete, or current, and we are not responsible for outcomes of campaigns run using verified data.
11. Limitation of Liability
To the maximum extent permitted by law, Connect2Contact and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.
12. Indemnification
You agree to indemnify and hold Connect2Contact harmless from any claims, damages, or expenses arising from your use of the Service, your uploaded data, or your violation of these Terms or applicable law.
13. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
